In the context of purchase contracts that are concluded via the online shop victorianhouse-shop.de.

§ 1 scope

The following terms and conditions apply to all contracts concluded between The Victorian House Gastro GmbH and the customer via the online shop "victorianhouse-shop.de", unless expressly agreed otherwise. Deviating conditions of the customer are not recognized unless they have been expressly approved.

§ 2 Formation of the contract / storage of the contract text

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog.
To purchase our goods, you can click on the desired products on the website www.victorianhouse-shop.de and add them to the shopping cart. At the end of your order you will receive an overview of the goods in the shopping cart, including the price, delivery costs and VAT. Before sending your order, you have the opportunity to check all entries, such as name, address, delivery address, number and type of goods, details of payment and to make changes or corrections.
By clicking the button "Buy" / "order with payment" you then place a binding order for the goods contained in the shopping cart.
The receipt of your order is confirmed together with the acceptance of the order immediately after sending it by automated email. With this email confirmation, the purchase contract is concluded.
The contract text is saved by us. You can print this out after sending your order to us by clicking on the "Print" button. We will also send you an order confirmation with all order details and our general terms and conditions to the email address you provided.

§ 3 Subject of the contract, product quality, availability

The subject of the contract are the goods and final prices specified and confirmed in the order.
The quality of the ordered goods results from the product description in the online shop. Illustrations on the website are for illustration purposes only and may only reflect the products inaccurately.
We strive to offer you the highest possible quality. Our extensive range is therefore subject to constant changes due to seasonal items or supplier changes. "If a product is not available at the time of dispatch, we offer you a corresponding replacement product that is at least equivalent. In this case, you as the customer are not obliged to purchase this replacement product. There are no disadvantages for you.

§ 4 prices, shipping costs

The prices at the time the order is placed by the customer apply. The purchase price includes the respective statutory VAT.
The shipping costs for Germany and the EU abroad are flat rate € 6.50. For Switzerland and other third countries, a flat shipping fee of EUR 12.00 will be charged.

§ 5 payment, shipping

The purchase price is due upon conclusion of the contract. The purchase price is made up of the purchase sum and the shipping fee, if such is charged.
Payment can be made by credit card (Mastercard / Visacard / American Express), Paypal, by payment in advance, or by immediate transfer.
With every order we reserve the right not to offer certain payment methods and to refer to other payment methods. If the customer's place of residence is outside Germany, payment is only possible in advance.
The payment process is as follows:

Procedure for payment in advance

(1) You will receive our bank details and the order number in the confirmation email of your order.

(2) Please transfer the invoice amount stating the order number to our following account:

Any transfer costs and bank charges are to be borne by the customer.

(3) The goods are dispatched after receipt of payment.

Payment process by SOFORT transfer

(1) If you select the SOFORT transfer as a payment option when making your online purchase, you will be automatically forwarded to a secure payment form from SOFORT AG. The SOFORT transfer can be used with the online current accounts of most banks.

(2) The transfer data will be recorded automatically. You only have to enter your bank's routing number and your usual online banking access data. Finally, release the transfer with a TAN.

(3) The data is encrypted and transmitted to your online banking account. We will then receive a real-time confirmation of the transfer to your online banking account and can then process and send your order immediately.

(4) The customer does not incur any costs for the SOFORT transfer.

(5) Credit notes from returns are posted back to your online bank account.

Procedure for payment by credit card

(1) We accept the following credit cards: Mastercard / Visacard / American Express.

(2) When paying by credit card, you must provide us with the name of the cardholder, the card number, the card verification number and the expiry date of the credit card.

(3) When paying by credit card, the amount to be paid will be debited to your credit card account immediately. Once the invoice amount has been reserved in your credit card account, we can process your order immediately after ordering.

(4) Credit notes from returns will be posted back to your credit card.

Payment process via PayPal

(1) If you choose to pay with the online payment system PayPal, you will be forwarded directly to PayPal. A PayPal account is required for payment. If necessary, you can also open this during the ordering process.

(2) Your PayPal account will be charged when the order is completed.

(3) Further information about PayPal can be found at: www.paypal.de

In the case of prepayment, the goods are dispatched after receipt of payment. When paying by immediate transfer, the goods are dispatched immediately after receipt of the transaction confirmation by the bank. When paying by credit card or PayPal, the shipment is made after the reservation of the invoice amount by the respective partner company.
The goods are dispatched by Deutsche Post (DHL). The delivery takes place in Germany within 2-3 working days after receipt of payment from the transferring bank (advance payment) or after conclusion of the contract (for payment by credit card, direct transfer or PayPal).
At victorianhouse-shop.de all data is encrypted using SSL standard 3.0 (TLS).

§ 6 retention of title

The delivered goods remain the property of The Victorian House Gastro GmbH until full payment and all other goods of the same order.

§ 7 right of withdrawal / cancellation policy for consumers / exclusion of the right of withdrawal

Consumers have a right of withdrawal in accordance with the following provisions. A consumer is any natural person who concludes a legal transaction for purposes that can largely not be assigned to their commercial or professional activity.

Right of withdrawal

As a consumer, you have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To meet the cancellation deadline, it is sufficient for you to send your communication regarding your right of cancellation before the cancellation period expires.

Consequences of cancellation:

If you cancel this contract, we have made all payments to you that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you chose a different type of delivery than the cheap standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the nature, properties and functionality of the goods.

Exclusion of the right of withdrawal / expiry of the right of withdrawal

The right of withdrawal does not exist for:

(1) Contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer.

(2) Contracts for the delivery of goods that can spoil quickly or whose expiration date would quickly be exceeded.

(3) Contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

§ 9 warranty

The guarantee is based on the statutory provisions. As far as used goods are the subject of the purchase contract and the beetle is not a consumer, the warranty is excluded.

§ 10 Applicable law / place of jurisdiction

(1) German law applies to the contractual relationship to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

(2) Place of jurisdiction for contracts with wholesalers, legal entities under public law and buyers who have no general place of jurisdiction in Germany is Munich.

§ 11 Youth Protection Act:

In accordance with the provisions of the Youth Protection Act, we do not send brandy, brandy-containing drinks or foods that contain brandy in small quantities to children and young people under the age of 18, and other alcoholic beverages to children and young people under the age of 16. We reserve the right to check the age of majority.

§ 12 Notices to end users in accordance with the battery and electrical law

Since batteries and rechargeable batteries can be included in our shipments, we are obliged under the Battery Act (BattG) to inform you of the following:

This symbol indicates that batteries must not be disposed of with household waste. You are legally obliged to return used batteries.

Batteries that contain more than 0.0005 percent mercury (Hg), more than 0.002 percent cadmium (Cd) or more than 0.004 percent lead (Pb) contain the chemical name of the pollutant used under the garbage can symbol.

You can dispose of used batteries at a municipal collection point or in local stores. As distributors of batteries, we are also obliged to take back used batteries, whereby our return obligation is limited to used batteries of the type that we have or have had as new batteries in our range. You can either return old batteries of the aforementioned type to us with sufficient postage or return them free of charge to our shipping point at the following address:

Electrical and electronic devices must not be disposed of with household waste. Please dispose of these devices at the collection points for electronic waste at your community.
